The EB-2 National Interest Waiver (NIW) is a provision within the employment-based second preference (EB-2) immigrant visa category that permits a qualified foreign national to seek a waiver of the job-offer and labor-certification (PERM) requirements by demonstrating that the proposed endeavor is in the national interest of the United States. In addition to establishing eligibility for the EB-2 classification based on an advanced degree or exceptional ability, the petitioner must satisfy the three-prong framework established in Matter of Dhanasar.
