A specialty occupation requires: (a) theoretical and practical application of a body of highly specialized knowledge; and (b) attainment of a bachelor’s or higher degree in a specific specialty as a minimum for entry into the occupation. OOH and O*Net – the most common resources describing various occupations in terms of the knowledge, skills, and abilities required is widely referenced for H1B petitions. OOH entry for a certain occupation at times states that a bachelor’s degree is required but lists multiple acceptable fields of study. When petitioners use multiple educational prerequisites for a specialty occupation position, it is highly likely that USCIS issues an RFE.
