EB-1C is a subcategory of EB-1 (Immigrant visas in the First Preference) intended for multinational managers/executives. Multinational executives and managers who seek to start a business or businesses in the U.S. may apply for an EB-1C. This category allows foreign enterprises to grow their business in the U.S. by allowing the transfer of executives and managers with firsthand experience of the company operations to the United States to help with the start-up. To be eligible, an individual must work as a manager or executive for a multinational firm. Additionally, they need to have worked as either a manager or executive at a related foreign entity for at least one (1) year within the last three (3) years. The petitioning employer must be a U.S. employer who intends to employ the beneficiary in a managerial or executive capacity. No labor certification is required.
