Business Necessity Letter ( For PERM Audit)

The PERM labor certification process requires a U.S. employer to establish that the requirements for the offered position are appropriate for the occupation and necessary to perform the job. When the position includes requirements that may be considered more restrictive than those normally associated with the occupation, the Department of Labor (DOL) may request documentation demonstrating the business necessity of those requirements. Business necessity issues may arise, for example, where a position requires a master’s degree or equivalent combination of education and experience, less than a bachelor’s degree, specialized certifications or qualifications that are not typically required for the occupation, or experience or training obtained with the sponsoring employer.
